1. Agreement to These Terms
These Terms of Use (“Terms”) form a binding agreement between you and SAILING TECHNOLOGY LIMITED (“Sailing,” “we,” “us,” or “our”) and govern your access to and use of the Novi Drama mobile application, website, content, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility and Accounts
You must be at least 13 years old, or the higher minimum age required in your location, to use the Services. If you are under the age of legal majority, a parent or legal guardian must review and agree to these Terms on your behalf. You are responsible for providing accurate account information, protecting your login credentials, and all activity under your account. Notify us promptly if you believe your account has been compromised.
3. License to Use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services and stream available content for your private, non-commercial entertainment. No ownership rights are transferred to you.
4. Subscriptions, Purchases, and Billing
Some features or content may require payment, virtual items, or a subscription. Prices, billing periods, renewal terms, and included benefits will be shown before purchase. Payments made through an app store are processed under that store’s payment terms. Unless otherwise stated or required by law, subscriptions automatically renew until canceled through the platform where you purchased them. Cancel before the renewal date to avoid the next charge. Fees are non-refundable except where required by law or permitted by the applicable store policy.
Virtual items, credits, or similar digital benefits have no cash value, cannot be transferred outside the Services, and may be modified or discontinued to the extent permitted by law.
5. Acceptable Use
You may not:
- copy, record, download, distribute, publicly perform, sell, or commercially exploit the Services or content except as expressly permitted;
- circumvent access controls, digital rights management, geographic restrictions, or security measures;
- reverse engineer, decompile, scrape, automate access to, or interfere with the Services;
- use the Services for unlawful, fraudulent, abusive, or harmful purposes;
- impersonate another person or misrepresent your affiliation; or
- upload malware or attempt to gain unauthorized access to accounts, networks, or systems.
6. Content and Intellectual Property
The Services, including all films, episodes, artwork, designs, software, text, trademarks, and other materials, are owned by or licensed to Sailing and are protected by intellectual property laws. “Novi Drama” and related branding may not be used without our prior written permission. Third-party content remains the property of its respective owners.
7. Feedback
If you send us ideas, suggestions, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation, provided we do not identify you publicly without permission.
8. Service Availability and Changes
Content and features may vary by device, location, and time. We may add, remove, modify, suspend, or discontinue content or any part of the Services. We do not guarantee that specific content will always remain available or that the Services will be uninterrupted or error-free.
9. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, fail to pay applicable charges, or use the Services in a way that harms us, our users, or others. Provisions that by their nature should survive termination will remain in effect.
10. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of Liability
To the maximum extent permitted by law, Sailing and its affiliates, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid us for the Services during the twelve months before the claim or USD 50. These limitations do not apply where prohibited by law.
12. Your Consumer Rights
Nothing in these Terms limits rights you may have under mandatory consumer protection laws. If the law in your place of residence gives you rights that cannot be waived, those rights prevail to the extent of any conflict with these Terms.
13. Disputes and Applicable Law
Before starting a formal claim, you agree to contact us and attempt to resolve the dispute informally. These Terms are governed by the laws applicable to SAILING TECHNOLOGY LIMITED, without regard to conflict-of-law rules, except where the mandatory laws of your place of residence apply. Any dispute will be brought before a court of competent jurisdiction unless applicable law requires otherwise.
14. Changes to These Terms
We may update these Terms to reflect changes to the Services, law, or our practices. We will post the revised Terms and update the effective date. Where required, we will provide additional notice. Continued use of the Services after the updated Terms take effect means you accept them.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, or transfer of our business or assets.
